Stamp duty is a mandatory state tax you pay when buying a property. Paying this fee legally establishes your ownership in government records. Failing to pay correct stamp duty can render your property documents invalid in a court of law.
How to minimize stamp duty costs?
- Register in a Woman's Name: Many states like Delhi, UP, Punjab, and Haryana offer a 1% to 2% discount if the primary owner is female, to promote female homeownership.
- Joint Ownership: Registering the property jointly with your spouse can also fetch a partial discount in certain states compared to a sole-male registration.
- Check Circle Rates: Stamp duty is paid on the Agreement Value OR the Government Circle/Guidance rate, whichever is higher. Always ensure your deal price is aligned correctly with local circle rates.
Standard Registration Fees
While stamp duty can range wildly from 4% to 7%, the registration fee (paid to the sub-registrar office) is usually locked at 1% of the property value across most states. Some states cap this number. For example, Maharashtra caps the registration fee at ₹30,000 for properties above ₹30 Lakhs.
